DMCA copyright policy
1. Introduction
Welcome to Nesva (“we,” “us,” or “our”). We respect the intellectual property rights of others and are committed to complying with the Digital Millennium Copyright Act (“DMCA”) and other applicable copyright laws. This DMCA Copyright Policy outlines our procedures for addressing copyright infringement claims on our platform.
2. Reporting copyright infringement
If you believe that your copyrighted work has been infringed upon on Nesva’s platform, follow the steps below to submit a valid DMCA notice:
- Identify the copyrighted work that you claim has been infringed.
- Identify the content on Nesva’s platform that you believe infringes your copyright, including specific URLs.
- Provide your contact information, including your name, address, telephone number, and email address.
- Include a statement that you have a good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law.
- Include a statement that the information provided in your notice is accurate, and that you are the copyright owner or authorized to act on the copyright owner’s behalf.
- Include your physical or electronic signature.
Send the DMCA notice to our designated agent (see Section 5 below).
3. Counter-notification
If you believe that content you posted was removed or access to it was disabled as a result of a mistake or misidentification, you may submit a counter-notification. Provide the following:
- Identify the specific content that was removed or disabled and the location at which the content appeared before removal or disabling.
- Provide your contact information, including your name, address, telephone number, and email address.
- Include a statement under penalty of perjury that you have a good faith belief that the content was removed or disabled as a result of mistake or misidentification.
- Include a statement that you consent to the jurisdiction of the federal district court in the judicial district in which your address is located (or, if your address is outside of the United States, the United States District Court for the District of Delaware), and that you will accept service of process from the person who provided the original DMCA notice.
- Include your physical or electronic signature.
Send the counter-notification to the same designated DMCA agent listed in Section 5.
4. Repeat infringers
We may terminate, in appropriate circumstances, the accounts of users who are repeat infringers of copyrighted works. If a user’s account is terminated due to repeated copyright infringement, they may lose access to their account and our platform permanently.
