This Privacy Policy governs the manner in which Nesva (“we,” “us,” or “our”) collects, uses, maintains, and discloses information collected from users (“users,” “you,” or “your”) of our cloud services. “The SITE” or “SITE” refers to https://www.nesva.net.
This Policy describes how we use information obtained about you when you visit our SITE or when you enroll in, or otherwise use, our online offerings. This Policy does not cover information we may obtain from or about you through channels other than use of the SITE.

- User content: Our “Community” features may allow you to publish content on our services. By registering for our Community, you agree that your profile information and the content you post may be viewed and used by other users and third parties we do not control.

- To respond to inquiries or provide customer support: Personal information helps us respond to inquiries, provide technical assistance, and offer customer support.
- To conduct research and analyze trends: We may use aggregated and anonymized information to analyze user trends, monitor usage of our services, and improve our offerings.

2.2 Non-personal information

3. Information protection
We adopt appropriate data collection, storage, and processing practices, as well as security measures, to protect against unauthorized access, alteration, disclosure, or destruction of personal information, usernames, passwords, transaction information, and data stored on our platform.
While we strive to use commercially acceptable means to protect your information, no method of transmission over the internet or electronic storage is 100% secure. Therefore, we cannot guarantee absolute security.

4. Information sharing
We do not sell, trade, or rent users’ personal information to third parties. We may share generic aggregated demographic information not linked to any personal information regarding visitors and users with our business partners, trusted affiliates, and advertisers for the purposes outlined above.
We may disclose personal information to third-party service providers who assist us in operating our business or servicing users, as long as those parties agree to keep this information confidential and comply with applicable data protection laws.
In certain circumstances, we may be required to disclose personal information to comply with a legal obligation, protect our rights or the safety of others, investigate fraud, or respond to a government request.
- In response to legal process: We may disclose information we collect from you to comply with the law, a judicial proceeding, court order, or other legal process, including in response to a court order or subpoena.
- To protect us and others: We may disclose information we collect from you where we believe it is necessary to investigate, prevent, or take action regarding illegal activities, suspected fraud, situations involving potential threats to the safety of any person, violations of our Terms of Service, Acceptable Use Policy, or this Policy, or as evidence in litigation in which Nesva is involved.
- Aggregate and de-identified information: We may share aggregate or de-identified information about users with third parties for marketing, advertising, research, or similar purposes.
- Forum users: If you create an account to use one of our forums, your forum profile, directory information, and any information you post on our forums may be available to other forum users and SITE visitors.
- Affiliates: We may disclose information we collect from you to our affiliates or subsidiaries; if we do so, their use and disclosure of your personal information will be subject to this Policy.
- Service providers: We may disclose information we collect from you to third-party vendors, digital wallet companies, contractors, or agents who perform functions on our behalf.
- Referral sign-ups: If you sign up for our services through a referral from a friend, we may share information with your referrer so they know you used their referral to join.

5. Third-party websites and services
Users may find advertising or other content on our website that links to the websites and services of our partners, suppliers, advertisers, sponsors, licensors, and other third parties. We do not control the content or links on those websites and are not responsible for the practices employed by websites linked to or from our site.
Browsing and interaction on any other website, including websites that have a link to our site, is subject to that website’s terms and policies. We encourage users to review the privacy policies of any third-party websites they visit.
6. Cookies and tracking technologies
We use cookies and similar tracking technologies to enhance user experience and collect information about how users interact with our website and services. Cookies are small text files stored on a user’s device. They enable us to remember user preferences, analyze usage patterns, and improve our services.
Users may set their browsers to refuse cookies or to alert them when cookies are being sent. Some parts of our website may not function properly if cookies are disabled.
Do-not-track: Our systems do not currently respond to browser “do-not-track” signals. You may disable certain tracking as described in this section (for example, by disabling cookies). You may also opt out of targeted advertising using the instructions in the third-party ad network section below.

Users have certain rights regarding their personal information, subject to applicable data protection laws. These rights may include:
- The right to access and obtain a copy of personal information we hold about you.
- The right to rectify inaccurate or incomplete personal information.
- The right to erase personal information in certain circumstances, such as when it is no longer necessary for the purposes for which it was collected.

8. Children’s privacy
The Children’s Online Privacy Protection Act (COPPA) applies to the online collection of personal information from children under 13. Nesva does not knowingly collect personal information from children under 13. Our SITE is not directed to children under 16, and children under 16 are not authorized to access or use our services without appropriate consent. If we learn that a child under 13 has provided us with personal information, we will endeavor to delete that information promptly.
9. International transfers
We may transfer personal information to servers located in countries other than your home country. Those countries may have different data protection laws than your jurisdiction. By using our services, you consent to the transfer of your personal information to those countries.
10. Retention of personal information
We retain personal information for as long as necessary to fulfill the purposes for which it was collected, including any legal, accounting, or reporting requirements.

Your data protection rights under the GDPR
The General Data Protection Regulation (GDPR) strengthens protections for personal data in the EU and became enforceable on May 25, 2018. Nesva supports the GDPR, and our services are designed to align with its requirements.
If you are a resident of the EEA, you have the following data protection rights:
- If you wish to access, correct, update, or request deletion of your personal information, you may do so at any time by emailing [email protected].
- To exercise your rights to deletion of your personal data under the GDPR, you may deactivate and purge your account in your control panel settings (https://cloud.nesva.net/settings). Account data will be deleted within 90 days of purging.
- You may object to processing of your personal data, ask us to restrict processing, or request portability of your personal data by emailing [email protected].
- You may opt out of marketing communications at any time by clicking the “unsubscribe” link in marketing emails we send you, or by contacting us at [email protected] for other types of marketing.
- If we have collected and processed your personal data with your consent, you may withdraw your consent at any time. Withdrawing consent will not affect the lawfulness of processing before withdrawal, or processing based on lawful grounds other than consent.
- You have the right to complain to a data protection authority about our collection and use of your personal data. For more information, contact your local data protection authority.
We respond to requests we receive from individuals wishing to exercise their data protection rights in accordance with applicable data protection laws.
Additional disclosures: CCPA privacy notice (California)
If you are a California resident, the California Consumer Privacy Act (CCPA), as amended by the CPRA, may provide you with additional rights regarding our use of your personal information. This section supplements the information elsewhere in this Policy.
- Categories of personal information collected: In the preceding 12 months, we may have collected the categories described in Section 1 above, including identifiers, commercial information, internet or network activity, and geolocation data, depending on how you use our services.
- Business or commercial purposes: We use personal information for the purposes described in Sections 2 and 4, including to provide services, security, analytics, and compliance.
- Sharing and sales: We do not sell users’ personal information as defined under the CCPA. We may share personal information with service providers and as described in this Policy.
- Your California rights: Subject to certain exceptions, California residents may have the right to know, delete, correct, and opt out of certain sharing of personal information, and not to receive discriminatory treatment for exercising these rights.
